Event Hire TERMS OF SERVICE

DEFINITIONS

1.     The ‘Hire Company’ is Balloons N Beyond.

2.     The ‘client’ refers to any individual, couple or company hiring items from the ‘hire company’  who has signed the hire agreement.

3.     The ‘item/s’ refers to all signage stands, backdrops, props, décor, accessories, accessories, balloons and other item from our event ‘hire’ collection supplied to the ‘client’.

CONDITIONS OF HIRE:

The client agrees to have read, understood and acknowledge all terms & conditions by the way of signature & making appropriate payment(s)of the hire agreement, agrees to all clauses in this document.

BOOKING SECURITY:

To secure all item/s for your booking, the deposit requires payment no later than due date outlined, alongside hire agreement signed to acknowledge you have read, agree and understand the hire term and conditions.  Should this not be actioned by the requested due date, the hire company have the authority to forfeit this agreement & hire item/s to another client. Hiring of the item/s will commence from commencement date specified by the hiring company and shall be collected &/or returned to or by the hire company by the date specified by the hire company as outlined in contract.

DEPOSIT / PAYMENT TERMS: 

For any client booking over the value of $1000.00, A non refundable 50% retaining fee (50% of total booking order amount including GST, security bond and incurred delivery / set up installation / collection fee) is required at time of booking to secure chosen item/s. The retaining fee enables the hire company to secure your installation date. Once order is accepted, we can commence the collaborating process and styling all elements required to accomplish a professional service for our clients.  The remaining balance of 50% of booking is due in full, requiring payment by the client no later than 7 days prior to date of event as specified in terms on the invoice.  All payments can be made by direct debit or credit card into the hire company’s bank account by the specified due date. Please be mindful that credit card surcharge will be added to our final balance if your preferred payment is to pay via credit card.  Please note, shall final payment not be made 7 days prior to specified event date, the hire company reserves the right to no longer supply any item/s for the event. Furthermore, no deposit will be reimbursed to the client should this occur. 

RESERVATIONS & CONFIRMATION:

Due to the overwhelming high demand of our services, availability of our services is confirmed with our client during consultation. However, until a retainer fee (50%) is paid and service agreement is signed and confirmed by the client & Balloons N Beyond Managing Director (Christine), you event is not officially booked, nor is the date reserved for your installation secure until retainer fee is paid. To avoid disappoint, it is suggested to make payment as soon as possible with receipt of invoice to avoid any distress. The client has until due date on invoice to make payment of retainer fee & the final payment prior to date of installation. Failure to make adequate payment by given due date may result in any/all the following: invalidation/removal of any applicable discounts, special promotions, complimentary services. The forfeiture of existing payments made. The release of event date/time/ venue. Termination of contract.

CANCELLATION POLICY:

The client has the right to cancel their order at anytime, although acknowledges they will forfeit all payments previously made to the hire company (regardless of whether that payment was made in full, or 50% deposit) due to the limited availability on our item/s.

Cancellation of a booking due to weather conditions, or any situation out the the control of the hire company, shall still be subject to the cancellation policy above. The hire company is no way responsible or liable for weather or client’s personal circumstances that may cause client to cancel their event or booking.

RESCHEDULING:

It is within the clients autonomy to reschedule the installation. However, this requires a minimum of 7 days’ notice in writing prior to event taking place. The client has the right to reschedule for any date within the next 365 days of the calendar year, subject to the availability of Balloons N Beyond, without being charged a cancellation fee. We must make emphasis the rescheduling date of subject to availability. If for some reason we are unable to assist on requested rescheduled date, cancellation policies & fees will apply. We request that if a client is required to reschedule, they include approximate preferred date to reschedule, & a second preference date in the event that the first choice in unavailable. If client is unable to reschedule, the stipulated amount cannot be transferred to another client.

SECURITY BOND:

Every item in our hire collection catalogue requires a bond to be paid by the client & to be held by the hire company. This security bond will be reimbursed by the hire company to the client when all item/s are returned to the hire company in the same condition as what was hired out to the client.

All bonds will be returned to client minus any fee incurred either due to late fee/ extension fee and/or breakage/damage fee in which bond will be withheld.

The amount of bond will be as specified in contract for all signage boards, backdrops, wishing wells & signs, etc. For smaller styling item/s and accessories, amount specified in contract security bond will be held.

Any unreturned or un-reusable items will be charged to the client as a full replacement cost. The replacement costs will be outlined on your hire agreement.

A late return fee of $100 per day(s) will be charged where the client fails to return item/s by the due date outlined in the hire agreement.

DAMAGE,LOST,STOLEN OR UN-RETURNED ITEMS:

All re-useable, equipment / décor hired and specified within this contract, are the property of the hire company. The client is responsible for all losses, damages, theft, vandalism, misplacement of any item hired from the hire company, in which the client agrees to be billed foe the repair or replacement cost of those nominated item(s). Upon delivery of the item/s & until the return of the item/s to the hire company’s premises, the client has full responsibility of all/ any item hired.

The client shall protect the hire item/s from the elements during the time of hire. In poor weather conditions storage of the hire item/s may be necessary & is the responsibility of the client to see that the item/s are stored safely. Any item damaged from weather is the full responsibility of the client and shall be paid at full replacement cost to the hire company.

Any items collected and returned by the client shall be delivered back to the hire company in a clean and well-maintained condition. Should an item become damaged while in the possession of the client, it is the client's responsibility to notify the hire company immediately after the event should the item not be in a satisfactory condition. It is then at the hire companies’ discretion to charge the replacement fee which is outlined on every hire agreement specific to each item. Once item/s are delivered/picked up, the client assumes all responsibilities and liabilities relating to the agreed item/s while in their possession until they have been collected/received back by the hire company.

DELIVERY / SET UP / INSTALLATION / COLLECTION:

Fees will be charged to the client for any delivery and/ retrieval of item/s. This fee will vary depending upon distance travelled from the hire company’s premises, amount of item’s hired, amount of setup required and installation time (if any). The client will be advised of the delivery fee once all hire item/s have been decided upon. This fee may be subject to change should the client then change the amount of item/s hired. Unless a setup fee has been charged and agreed upon by the hire company, the hire company in not responsible for the set-up of item/s.

Delivery & retrieval will occur at the business / event venue location, at an agreed time (by appointment). 

For those hire items available for client pick-up/ return, these shall be collected on an agreed day (by appointment) at an agreed time at the hire company.

The hire period shall begin and end at the time of delivery /client pick-up and return / retrieval, at the location agreed by both the client and the hire company.

SOCIAL SHARING / PHOTOS:

The client consents to allow the hire company to use any images shown on social media that display creative use of item/s hired while at the clients event. The hire company will endeavor to credit any photographers & other suppliers involved.

Balloons N Beyond obtain the right to share all our work on social media platforms such as websites, social platforms (Pinterest, Facebook, Instagram, etc). We kindly request you advise us via email via our contact form if you do not wish us to do so.
